Incident Reporting Obligations for J-1 Exchange Visitors

OIS has a responsibility to report any incidents or allegations involving J-1 exchange visitors to the U.S. Department of State pursuant to 22 CFR 62.13(d).

Sponsoring departments and exchange visitors must report incidents within one business day to OIS if one of the following incidents occurs:

• Actual or potential negative press
• Death of an exchange visitor
• Exchange visitor missing, absconder or overstay
• Foreign government involvement
• Fraud
• Incident involving the criminal justice system
• Incidents involving Child Protective Services
• Lawsuits or formal complaints by an exchange visitor against the sponsor alleging unlawful affirmative action
• Lawsuits or formal complaints by an exchange visitor against the sponsor alleging unlawful DEI policies
• Litigation (lawsuits) or other legal actions
• Lost or stolen immigration documents
• Port of entry issues
• Proscribed antisemitic actions
• Public security incidents or natural disasters directly involving the exchange visitor’s safety
• Serious behavioral problems
• Serious medical issues
• Serious mental health concerns
• Serious violations of university conduct rules
• Sexually-related incidents or abuse
• Terrorist activity, endorsing or espousing terrorism
• Theft of intellectual property or violations of import/export controls
• Unsuitable host/work conditions
